By booking a tour with Graham’s Orkney Tours, you are agreeing to the following Terms & Conditions.

1. Deposit and Payment

1.1. A 50% deposit requires to be paid at the time of booking. This deposit is non-refundable, except in the circumstances set out in clauses 2.1 and 2.3 below.

1.2. Payment of the remaining 50% of the cost of your tour (the “Balance Payment”) must be made no later than 60 days before the first day of the tour.

1.3. Failure to pay the amount referred to in Clause 1.2 within the required timescale will result in cancellation of the booking.

1.4. Payment should be made by bank transfer, or using an online card payment system. Cash or cheques will only be accepted in exceptional circumstances and at the sole discretion of Graham’s Orkney Tours.

1.5. Bookings made within 60 days of the date of the tour must be paid in full at the time of booking.

2. Cancellation

2.1. Shared tours will only proceed with a minimum of 2 customers (with the exception of the Highlights Tour, where the minimum is 3 customers). In the event that only one customer books a place on a tour, the customer will be offered a choice of either joining another tour, purchasing another seat, or cancelling and receiving a full refund.

2.2. Customers may cancel a booking at any time, and will be entitled to the following refunds:

2.2.1. Cancellation 28 or more days prior to the first day of the booked tour – 50% refund of any Balance Payment already paid by the customer.

2.2.2. Cancellation less than 28 days prior to the first day of the booked tour – no refund.

2.3. Graham’s Orkney Tours may cancel a tour at any time prior to a tour commencing, in which case the customer shall be entitled to a full refund of all amounts paid. In the unlikely event that a tour requires to be cancelled by Graham’s Orkney Tours when it has been partially provided, the customer shall be entitled to a pro-rata refund of all amounts paid.

2.4. In the event of adverse weather, travel disruption or delay, personal circumstances or any other unforeseen circumstances which may result in customers being unable to attend their booked tour, customers must contact Graham’s Orkney Tours as soon as possible. Graham’s Orkney Tours will endeavour to delay or reschedule the tour.

2.5. Where it is not possible to delay or reschedule the tour in accordance with Clause 2.4, including where customers have a limited amount of time in Orkney such as shore excursion guests from cruise liners, then the booking will be deemed to be cancelled and the refund policy referred to in Clause 2.2 will apply.

3. Itineraries

3.1. Graham’s Orkney Tours will use reasonable endeavours to visit all the sites and attractions advertised as being part of the tour. In the event of unforeseen circumstances such as site closure or severe weather, or in order to ensure that tours run safely and smoothly, Graham’s Orkney Tours reserves the right to adjust the tour itinerary.

4. Vehicle Occupancy

4.1. Shared tours will have a minimum of 3 customers and a maximum of 8 customers in the vehicle.

4.2. Private tours have no minimum number of customers, and a maximum of 8 customers.

4.3. Luggage is limited to one small bag or rucksack per customer.

4.4. Pets are not permitted on the vehicle, with the exception of assistance dogs.

5. Food and Allergies

5.1. The consumption of food and beverages in the vehicle (with the exception of water) is not permitted.

5.2. Customers must notify Graham’s Orkney Tours prior to attending a tour:

5.2.1. Of any allergies suffered; and

5.2.2. Of any foodstuffs to be carried in luggage on the vehicle, particularly where the foodstuffs may be associated with allergies such as peanuts or dairy products.

5.3. Graham’s Orkney Tours cannot be held responsible for any health issues or allergic reactions caused by exposure to foodstuffs or other products carried on board the vehicle by customers.

6. Smoking

Smoking, and the use of electronic vaping devices, is not permitted on the vehicle.

7. Accessibility

7.1. Customers with physical mobility issues should inform Graham’s Orkney Tours in advance. For private bookings, it may be possible to adjust itineraries to take account of any accessibility issues. For individual bookings on shared tours, the ability to adjust the itinerary is very limited and customers should check in advance that they are physically capable of visiting the sites included on the itinerary.

7.2. Although all reasonable adjustments will be made for those with physical mobility issues, Graham’s Orkney Tours cannot provide a wheelchair-accessible vehicle.

7.3. Whilst mobility aids such as electric buggies are available at some sites including Skara Brae, these are in limited supply and Graham’s Orkney Tours cannot guarantee availability of such aids.

8. Right to Refuse Service

8.1. Graham’s Orkney Tours will not tolerate any violent, abusive, offensive or disorderly behaviour by customers. Customers behaving in this way may be refused service at the sole discretion of Graham’s Orkney Tours, and will be fully responsible for any return transport arrangements. No refund will be provided in these circumstances.

9. Site Safety and Travel Insurance

9.1. By booking a tour, customers acknowledge that they may be entering heritage sites which are thousands of years old and/or walking on uneven terrain. Customers are responsible for following all safety advice, and all sites are entered at customers’ own risk.

9.2. Customers must ensure they wear footwear and clothing appropriate for the weather and the terrain.

9.3. Customers are responsible for obtaining their own appropriate travel insurance to cover any financial or other losses that may be suffered as a result of a tour being cancelled, or other costs, losses or injuries sustained as a result of taking a tour with Graham’s Orkney Tours.

10. Liability

10.1. Graham’s Orkney Tours shall have no liability whatsoever in respect of any loss, damages, costs and expenses of any nature suffered or incurred by a customer, except to the extent it is unlawful to contractually exclude such liability.
